Question:

It seems that having a credit card is haram. Because if you do not pay on time, you contract to commit a major sin. And contracting for a major sin appears to be sinful and impermissible.

جَزَاکَ اللَّهُ خَيْرًا


Answer:

بِاسْمِ اللہِ سُبْحَانَہٗ وَتَعَالٰی، الَّذِیْ عَلَّمَ الْإِنْسَانَ مَعَالِمَ الدِّیْنِ، وَأَنْعَمَ عَلَیْہِ بِحَقَائِقِ الشَّرِیْعَةِ وَالتَّمْکِیْنِ

The Actual Reason for the Impermissibility of Credit Cards

In credit cards of conventional banks, the reality is that the cardholder contracts with the institution on the condition that if the amount is not paid within the stipulated time, an additional amount, late fee, or markup will have to be paid as interest. Banuri Town has clearly stated that just as taking interest is haram, similarly entering into an interest-based contract is also haram; therefore, merely intending that I will pay on time does not remove the defect of the original contract.

Is Contracting with a Condition Involving a Major Sin Also a Sin?

Yes, your reasoning is very close to the preponderant view of the scholars. In a Hadith from Sahih Muslim, the Prophet ﷺ equated the one who consumes interest, the one who feeds interest, the one who writes the interest-based transaction, and the one who witnesses it. Muftis, inferring from this Hadith, have clarified that signing the documents of a credit card also constitutes entering into an interest-based transaction, and is haram.

Is mere “intention” sufficient, such that since I will not pay interest, the credit card becomes permissible?

According to the preponderant Hanafi fatwas, it is still not permissible. The reason is that the issue is not only about the subsequent action but also about the initial contract. Muftis have repeatedly written that the halal or haram status of a transaction depends on the contract agreed upon between the parties, and here the contract itself is based on an interest-based condition. Therefore, even in the case of timely payment, the permissibility in principle is not established.
